Terms of Service, Payments & Disputes Policy

These Terms of Service govern purchases from Build Bargain and use of the Build Bargain website.
Throughout these Terms, “Build Bargain,” “we,” “us,” and “our” refer to Build Bargain. “Customer,” “you,” and “your” refer to any person who accesses our website, places an order, submits payment, or otherwise purchases a product from Build Bargain.
By accessing our website, placing an order, submitting payment, or completing a purchase through Build Bargain, you acknowledge and agree to these Terms and all other applicable Build Bargain policies referenced herein.
Please review these Terms before completing a purchase.
1. Agreement to Build Bargain Policies
Purchases from Build Bargain are also subject to our applicable:
- Returns, Exchanges, Cancellations & Custom Orders Policy
- Shipping, Freight Delivery & Package Claims Policy
- Limited Warranty, Fitment & Installation Policy
- Product Disclosures & Regulatory Compliance Policy
- Privacy Policy
- Any product-specific terms displayed on the applicable product or collection page
- Any additional terms expressly disclosed on an applicable invoice or order
These policies form part of the terms applicable to your purchase.
When a product or order has additional terms specific to that product, configuration, or transaction, those additional terms also apply.
2. Eligibility to Purchase
By placing an order, you represent that you are legally permitted to enter into the transaction and that the information you provide is accurate.
If you are purchasing on behalf of another person, business, or organization, you represent that you have authorization to make the purchase and accept the applicable terms on their behalf.
Build Bargain may refuse or cancel an order when reasonably necessary to prevent fraud, comply with applicable law, correct an error, or protect Build Bargain, its customers, or its payment systems.
3. Order Information
Customers are responsible for reviewing their order before completing payment.
This includes confirming:
- Product selected
- Quantity
- Vehicle application
- Year, make, model, chassis, and trim when applicable
- Product options
- Colors
- Materials
- Custom configurations
- Billing information
- Shipping information
- Contact information
- Discounts or promotional codes
- Order total
Customers should contact Build Bargain as soon as possible if they discover an error after placing an order.
Changes and cancellations remain subject to the Returns, Exchanges, Cancellations & Custom Orders Policy.
4. Payment Authorization
By submitting a payment to Build Bargain, you represent that:
- You are authorized to use the selected payment method
- The payment information provided is accurate
- You authorize Build Bargain and its applicable payment processor to charge the amount displayed or otherwise agreed upon for the order
- You authorize applicable taxes, shipping charges, and other disclosed order charges
- You understand that the transaction may be processed by a third-party payment provider
Submitting an order does not guarantee that payment will be accepted or that the order will be fulfilled.
Orders may be subject to payment authorization, fraud review, verification, or other processing before fulfillment.
5. Website and Electronic Invoice Payments
Orders may be paid through the Build Bargain website or through an electronic or system-generated invoice provided by Build Bargain.
An electronic invoice is not considered paid until the applicable payment has been successfully received or authorized.
Website and electronic invoice orders remain subject to the applicable Build Bargain policies, including the 3% cancellation fee (which helps cover nonrefundable payment processing costs incurred when the original transaction is processed) described in the Returns, Exchanges, Cancellations & Custom Orders Policy when a customer-requested cancellation qualifies for that fee.
Unpaid quotes or invoices do not constitute completed purchases.
6. Package Protection and Waived Fees
If the customer adds and pays for Build Bargain Package Protection on the applicable order, the standard:
- 3% cancellation fee; and
- 10% restocking fee
will be waived for eligible cancellations, returns, and exchanges covered by the applicable Build Bargain policies.
Package Protection must have been purchased for the applicable order before the cancellation, return, or exchange request is made.
The Package Protection surcharge itself is nonrefundable, including if the customer later cancels the order, returns a product, or exchanges a product.
All other cancellation, return, and exchange requirements still apply. Package Protection waives the applicable cancellation and restocking fees only and does not automatically make an otherwise nonreturnable, final-sale, custom, damaged, installed, or otherwise ineligible product eligible for cancellation, return, or exchange.
Package Protection does not override any other applicable eligibility, inspection, warranty, shipping, or claims requirements contained in Build Bargain’s policies.
7. Fraud Prevention and Order Verification
Build Bargain may review orders for potential fraud, unauthorized payment activity, identity concerns, address inconsistencies, unusual ordering patterns, or other risk indicators.
Build Bargain may request additional verification before fulfilling an order.
Verification may include:
- Confirmation of the customer’s identity
- Confirmation of billing information
- Confirmation of the shipping address
- Confirmation that the customer authorized the transaction
- Additional contact information
- Vehicle information
- Identification when reasonably necessary
- Verification through the applicable payment provider
- Other information reasonably necessary to verify the transaction
Build Bargain may temporarily hold fulfillment while verification is being completed.
If an order cannot reasonably be verified, Build Bargain may cancel and refund the order.
8. High-Risk Orders
Build Bargain may take additional precautions for orders identified as unusually high risk.
These precautions may include:
- Additional payment verification
- Additional identity verification
- Signature-required delivery
- Adult signature
- Delivery-address verification
- Delayed fulfillment while the order is reviewed
- Contacting the customer
- Canceling and refunding the order when the transaction cannot reasonably be verified
A fraud review does not mean that Build Bargain is accusing the customer of fraud.
Its purpose is to protect both customers and Build Bargain from unauthorized transactions.
9. Pricing
Build Bargain makes reasonable efforts to provide accurate pricing.
Prices may change at any time before an order is completed.
A product price may be increased or decreased because of:
- Promotions
- Sales
- Inventory changes
- Product revisions
- Supplier costs
- Shipping costs
- Market conditions
- Business pricing decisions
- Other circumstances
The price applicable to a completed order is generally the price agreed upon when that order was placed, subject to pricing-error provisions below.
Later price changes do not automatically entitle an earlier purchaser to a refund, credit, or price adjustment.
Returns or exchanges intended to obtain later promotional pricing remain subject to the Returns, Exchanges, Cancellations & Custom Orders Policy.
10. Pricing and Website Errors
Occasionally, a product may be listed with an incorrect:
- Price
- Discount
- Description
- Specification
- Shipping charge
- Availability
- Inventory status
- Product option
- Promotion
- Image
- Other information
Build Bargain reserves the right to correct a genuine error.
If a material error affects an order before fulfillment, Build Bargain may contact the customer and provide the option to proceed under the corrected terms when appropriate or cancel and refund the affected order.
Build Bargain will not intentionally use a pricing or listing error to charge a customer an amount that the customer did not authorize.
11. Inventory and Availability
Product availability may change.
A product appearing available on the website does not guarantee that inventory will remain available until the order is processed.
Inventory discrepancies can occasionally occur because of:
- Simultaneous orders
- Inventory-count errors
- Damaged inventory
- Product inspection
- Supplier availability
- Product discontinuation
- System errors
- Other circumstances
If Build Bargain discovers that a product is unexpectedly unavailable or that the listed lead time is no longer accurate, we will contact the customer and provide an update. Customers may also contact us before placing an order to request the most up-to-date inventory status for a specific product.
Applicable processing, delay, cancellation, preorder, backorder, and custom-order terms are described in our other policies.
12. Promotions, Discounts and Coupon Codes
Build Bargain may offer promotions, sales, discount codes, bundles, collaboration pricing, or other special offers.
Unless expressly stated otherwise:
- Promotions may be changed or ended
- Discounts cannot be applied retroactively
- Offers are subject to stated expiration dates
- Offers may be limited to qualifying products
- Certain products may be excluded
- Discount codes may have minimum purchase requirements
- Discounts may not be combinable
- Only one promotional code may be permitted per order
- Quantity or customer limits may apply Build Bargain may refuse or cancel the use of a promotion when it is obtained or used through a
technical error, unauthorized manipulation, duplicate-account abuse, or other misuse.
Build Bargain may also restrict repeated purchases, returns, cancellations, or exchanges reasonably intended to improperly obtain promotional pricing.
13. Collaboration and Special Pricing
Build Bargain may occasionally offer special pricing in connection with a collaboration, promotional arrangement, content agreement, or other individually negotiated transaction.
Any collaboration requirements or special terms expressly agreed upon for that transaction also apply to the purchase.
Special pricing provided to one customer does not establish a general price available to other customers.
A customer receiving collaboration or individually negotiated pricing remains subject to applicable Build Bargain policies unless Build Bargain expressly agrees otherwise in writing.
14. Taxes
Applicable sales tax may be collected where required based on the transaction, shipping destination, applicable law, and information available to Build Bargain or its ecommerce platform.
International orders remain subject to the international and DDP terms contained in the Shipping, Freight Delivery & Package Claims Policy.
Customers are responsible for providing accurate information relevant to applicable tax treatment.
15. Payment Disputes and Chargebacks
Build Bargain encourages customers experiencing an order, product, shipping, return, warranty, or payment issue to contact us directly so that our customer support team has an opportunity to investigate and resolve the issue.
Customers may contact:

Customers should include their order number and a description of the concern.
Build Bargain will make reasonable efforts to review legitimate customer concerns and provide an appropriate response under the applicable Build Bargain policy.
16. Chargeback and Payment-Dispute Evidence
If a customer initiates a chargeback, financing dispute, PayPal dispute, payment-provider claim, or another payment dispute, Build Bargain may respond to that dispute and provide relevant evidence to the applicable bank, card issuer, payment processor, financing provider, payment platform, or other institution reviewing the claim.
Evidence may include, when relevant:
- Order information
- Payment records
- Billing information
- Shipping information
- Fraud-analysis information
- Checkout records
- Customer acknowledgment of applicable policies
- Product-page information
- Product descriptions
- Vehicle information
- Tracking information
- Delivery confirmation
- Signature confirmation
- Carrier information
- Delivery photographs
- Customer communications
- Emails
- Messages
- Photographs
- Videos
- Fitment information
- Installation information
- Warranty troubleshooting
- Replacement records
- Refund records
- Return records
- Cancellation records
- Other information relevant to the transaction or dispute
Build Bargain may explain the circumstances of the transaction and contest a dispute when the available evidence supports the validity of the charge, fulfillment of the order, delivery of the product, or another defense to the claim.
The final determination of a chargeback or payment dispute is made by the applicable financial institution or payment provider under its procedures.
17. Customers Are Encouraged to Contact Us Before Filing
a Dispute
When reasonably possible, customers are encouraged to contact Build Bargain before filing a payment dispute.
Many issues involving:
- Shipping
- Tracking
- Installation
- Fitment
- Missing components
- Warranty concerns
- Returns
- Exchanges
- Cancellations
may be resolved directly through our customer support process.
Contacting Build Bargain first gives us an opportunity to understand the problem and provide the applicable solution.
18. Active Payment Disputes and Direct Refunds
If a customer has already opened a chargeback or other payment dispute for an order, Build Bargain may need to address the disputed amount through the applicable payment provider’s dispute process.
Customers should inform Build Bargain if a payment dispute has already been filed when requesting a refund for the same transaction.
Build Bargain will not knowingly provide duplicate compensation for the same amount or loss.
If a refund has already been issued, Build Bargain may provide evidence of that refund to the financial institution or payment provider reviewing the dispute.
If a payment provider requires a dispute to be withdrawn or otherwise resolved before Build Bargain can separately issue an agreed direct refund, Build Bargain may provide the customer with the applicable instructions.
19. Fraudulent, False or Misleading Payment Claims
Customers may not knowingly submit false, fabricated, altered, or materially misleading information in connection with an order or payment dispute.
This includes knowingly making false claims concerning:
- Whether an order was authorized
- Whether a product was received
- What product was received
- Product condition
- Shipping damage
- Return status
- Refund status
- Warranty communications
- Customer communications
- Delivery
- Other material facts relating to the transaction
A legitimate disagreement, billing error, or good-faith payment dispute is not automatically considered fraud merely because Build Bargain disagrees with the claim or the dispute is decided in Build Bargain’s favor.
Build Bargain may preserve and submit relevant evidence concerning suspected fraudulent or misleading claims to the applicable payment provider or other appropriate party.
20. Duplicate Compensation and Double Recovery
Customers may not knowingly obtain or retain compensation more than once for the same product, transaction, or loss.
Examples include receiving or retaining:
- A Build Bargain refund and a chargeback credit for the same amount
- A replacement and a full refund for the same product
- Store credit and a full payment reversal
- Carrier compensation and a Build Bargain refund for the same loss
- Package-protection compensation and another full reimbursement for the same loss
- A refund from Build Bargain and reimbursement from another provider for the same amount
If duplicate compensation occurs, the duplicate amount must be returned or otherwise reconciled.
This section does not prevent customers from pursuing legitimate remedies; it prevents knowingly retaining compensation more than once for the same loss.
21. Abusive Transaction Activity
Build Bargain may refuse future orders or restrict purchasing privileges when a customer engages in repeated activity that reasonably indicates fraud, abuse, or intentional misuse of Build Bargain policies.
Examples may include:
- Repeated false claims
- Repeated unauthorized-payment claims contradicted by available evidence
- Deliberate promotional abuse
- Intentional duplicate refund attempts
- Repeated return abuse
- Fraudulent shipping claims
- Use of multiple identities or accounts to circumvent restrictions
- Threats or attempts to obtain compensation to which the customer is not entitled
Build Bargain will not restrict a customer merely because the customer submitted a legitimate complaint, honest negative review, good-faith warranty request, or lawful payment dispute.
22. Customer Communications and Records
Build Bargain may retain records reasonably related to customer transactions and support.
These may include:
- Orders
- Invoices
- Payments
- Customer emails
- Customer support messages
- Photos and videos submitted by customers
- Warranty communications
- Return communications
- Shipping information
- Tracking
- Delivery information
- Fraud-review information
- Other transaction-related records
These records may be used for customer service, order fulfillment, fraud prevention, warranty support, returns, payment disputes, legal compliance, and other legitimate business purposes subject to the Build Bargain Privacy Policy.
23. Customer Photos, Videos and Submitted Content
Customers may voluntarily provide Build Bargain with photographs, videos, reviews, installation photos, vehicle photos, or other content.
By voluntarily submitting content to Build Bargain for customer service, warranty, fitment, shipping, or claims purposes, the customer authorizes Build Bargain to use that content as reasonably necessary to investigate and resolve the applicable matter.
This may include providing relevant content to:
- Shipping carriers
- Manufacturers or suppliers
- Payment providers
- Financial institutions
- Insurance or package-protection providers
- Service providers assisting with the applicable claim
when reasonably necessary for the transaction or claim.
Build Bargain will handle personal information in accordance with its Privacy Policy.
24. Customer Reviews and Feedback
Build Bargain welcomes honest customer reviews and feedback.
Nothing in these Terms prohibits a customer from providing an honest review, opinion, assessment, or account of their experience.
Customers may not knowingly submit content that:
- Impersonates another person
- Uses fabricated evidence
- Contains unlawful threats
- Infringes another party’s rights
- Contains malicious software
- Is otherwise unlawful
A negative opinion or criticism of Build Bargain does not by itself violate these Terms.
25. Website Content
Build Bargain makes reasonable efforts to keep website information accurate and current.
Website content may occasionally contain:
- Typographical errors
- Outdated information
- Image differences
- Inventory discrepancies
- Pricing errors
- Specification errors
- Technical errors
- Other inaccuracies
Material errors affecting an order will be addressed as described in these Terms and the applicable Build Bargain policies.
26. Intellectual Property
Unless otherwise indicated, Build Bargain website content created or owned by Build Bargain, including applicable:
- Branding
- Website design
- Written content
- Graphics
- Product photography
- Original videos
- Logos
- Marketing materials
- Original product descriptions
may be protected by applicable intellectual-property laws.
Nothing in these Terms transfers ownership of Build Bargain intellectual property to the customer.
Third-party trademarks, vehicle manufacturer names, model names, and style references remain subject to the Product Disclosures & Regulatory Compliance Policy and the rights of their respective owners.
27. Prohibited Website Use
Customers and visitors may not intentionally use the Build Bargain website to:
- Commit fraud
- Submit unauthorized payments
- Interfere with website security
- Introduce malicious software
- Attempt unauthorized access to systems or accounts
- Scrape or copy protected content in violation of applicable law
- Manipulate promotions or checkout systems
- Impersonate another person
- Provide intentionally false transaction information
- Engage in other unlawful activity
Build Bargain may restrict access or transactions when reasonably necessary to protect the website, customers, or business.
28. Third-Party Services
Build Bargain may use or integrate third-party services for functions including:
- Ecommerce
- Payment processing
- Financing
- Shipping
- Tracking
- Reviews
- Fraud prevention
- Analytics
- Marketing
- Customer support
- Other website functionality
Third-party services may be subject to their own terms and privacy practices.
Build Bargain is not responsible for an independent third party’s acts or omissions except where responsibility cannot lawfully be excluded.
29. Product Use and Assumption of Responsibility
Automotive modification involves inherent risks.
Customers are responsible for:
- Selecting appropriate products
- Following applicable installation requirements
- Maintaining their vehicle
- Operating their vehicle safely
- Following applicable laws
- Using products for their intended applications
- Understanding how modifications may affect the vehicle
Product-specific safety, street-use, emissions, warranty, fitment, and installation terms are described in the Product Disclosures & Regulatory Compliance Policy and Limited Warranty, Fitment & Installation Policy.
30. Limitation of Liability
To the fullest extent permitted by applicable law, Build Bargain will not be liable for indirect, incidental, special, exemplary, punitive, or consequential damages arising from the purchase, installation, use, misuse, inability to use, or removal of a product.
This may include claims for:
- Loss of use
- Vehicle downtime
- Lost income
- Lost profits
- Rental-vehicle expenses
- Towing
- Storage
- Third-party labor
- Business interruption
- Other consequential losses
unless such liability cannot legally be excluded or limited.
Specific exclusions relating to installation labor and third-party expenses are also contained in the Limited Warranty, Fitment & Installation Policy.
31. No Waiver of Nonwaivable Consumer Rights
Nothing in these Terms or another Build Bargain policy is intended to eliminate, waive, or restrict a customer right or remedy that applicable law does not permit Build Bargain to waive or restrict.
If a provision conflicts with a nonwaivable requirement of applicable law, that legal requirement controls to the extent of the conflict.
The remainder of these Terms remains applicable to the extent permitted by law.
32. Governing Law
To the extent permitted by applicable law, these Terms and transactions with Build Bargain are governed by the laws of the State of California, without regard to conflict-of-law principles.
Customers may have additional rights under the laws applicable to their location.
Nothing in this section eliminates consumer protections that cannot legally be waived.
33. Informal Dispute Resolution
If a disagreement arises concerning an order, Build Bargain encourages the customer to contact us first so that both parties can attempt to resolve the issue directly.

Build Bargain will review the matter and respond through the applicable customer-support process.
This informal-resolution process does not eliminate any nonwaivable legal or payment-dispute rights available to either party.
34. Changes to These Terms
Build Bargain may update these Terms from time to time to reflect changes in:
- Business practices
- Website functionality
- Products
- Payment methods
- Laws or regulations
- Other operational requirements
The version applicable to a completed purchase is generally the version presented or made available in connection with that transaction, except where applicable law requires otherwise.
Updated Terms will apply prospectively to future transactions unless otherwise stated or required by law.
35. Severability
If any provision of these Terms is determined to be invalid, unlawful, or unenforceable, that provision will be limited or removed only to the extent necessary.
The remaining provisions will continue to apply to the fullest extent permitted by law.
36. No Waiver
If Build Bargain does not enforce a provision of these Terms in a particular instance, that does not automatically waive Build Bargain’s right to enforce that provision in another applicable situation.
Any voluntary exception provided to a customer does not automatically create a continuing obligation to provide the same exception in future transactions.
37. Entire Agreement
These Terms, together with the applicable Build Bargain policies, product-specific disclosures, and expressly agreed order-specific terms, constitute the applicable agreement concerning the customer’s purchase from Build Bargain.
If an individually negotiated written term expressly conflicts with a general term in these policies, the expressly agreed transaction-specific term may control for that particular transaction.
