Build Bargain sells aftermarket automotive products designed to modify, replace, enhance, or customize factory vehicle components.
Because aftermarket products may differ from original equipment and vehicles may vary by configuration, condition, modification history, region, and intended use, customers are responsible for reviewing applicable product information before purchasing and installing a product.
Please review this policy before placing an order.
By purchasing from Build Bargain, you acknowledge and agree to the terms below.
1. Aftermarket Product Notice
Unless specifically identified otherwise, products sold by Build Bargain are aftermarket products and are not original equipment manufacturer (OEM) components.
Aftermarket products may differ from factory components in areas including:
- Design
- Materials
- Construction
- Appearance
- Finish
- Weight
- Sound
- Performance
- Mounting methods
- Hardware
- Installation procedure
- Adjustment requirements
- Electronic functions
A difference from the factory component does not by itself mean that an aftermarket product is defective.
Product-specific fitment and installation concerns remain subject to the Limited Warranty, Fitment & Installation Policy.
2. BMW and Third-Party Brand References
Unless a product is specifically and expressly identified as a genuine OEM product, all products sold by Build Bargain are aftermarket products.
The use of names such as BMW, M3, M4, M340i, vehicle chassis codes, model names, or other manufacturer-related terms in a product title, description, fitment listing, or other website content is used only to identify the vehicle the product is designed for or compatible with.
The appearance of “BMW” or another vehicle manufacturer’s name in a product title or description does not mean that the product was manufactured, supplied, authorized, sponsored, endorsed, or approved by BMW or that manufacturer.
Build Bargain products are not intended to be represented as genuine BMW OEM products unless the applicable product listing expressly states that the product is a genuine OEM component.
If a product title or description uses the term “OEM” by itself, this means OEM-Style and refers only to the product being designed to match or resemble the style, appearance, fitment, or configuration of the original OEM version. It does not mean that the product was manufactured, supplied, authorized, or sold by BMW.
Only products that are specifically identified as “Genuine OEM BMW” are represented by Build Bargain as genuine BMW factory components.
BMW and any other third-party manufacturer names, model names, logos, trademarks, and related intellectual property belong to their respective owners.
Style Names and Third-Party Product References
Build Bargain may use commonly recognized style names or references in product titles and descriptions to help customers understand the general design, appearance, or configuration of an aftermarket product.
For example, a product described using terms such as “PSM,” “PSM Style,” “CS Style,” “CSL Style,” “M4 Style,” or another brand, model, or design reference is intended to describe the style or design inspiration of the product unless expressly stated otherwise.
Such terminology does not mean that the product was manufactured, supplied, licensed, authorized, sponsored, endorsed, or approved by the company, brand, or manufacturer associated with that style name.
For example, a product described as “PSM” or “PSM Style” is an aftermarket product designed in a PSM-style appearance and is not represented as a genuine product manufactured or supplied by PSM, unless the product listing expressly states otherwise.
Similarly, references such as CS Style, CSL Style, M4 Style, OEM Style, or similar terminology describe the intended design or appearance and do not represent the product as a genuine factory or third-party branded component.
Customers should rely on the product description to determine the actual manufacturer, construction, materials, specifications, and included components of the product being purchased.
3. Product Photos and Representation
Build Bargain makes reasonable efforts to accurately represent products through photographs, videos, descriptions, specifications, and other product information.
Product photos and videos are intended to provide a reasonable representation of the product.
Actual appearance may vary slightly because of:
- Lighting conditions
- Camera settings
- Screen settings
- Viewing angle
- Reflections
- Production variation
- Material characteristics
- Product revisions
- Manufacturing methods
- Vehicle configuration
Some product photos may show a product installed on a customer, demonstration, development, or modified vehicle.
Unless specifically stated otherwise, surrounding vehicle modifications, accessories, wheels, body components, lighting, or other products visible in an image are not included with the purchased product.
Customers should review the written product description and included-component information to determine what is included with an order.
4. Carbon-Fiber Products
Carbon fiber is a material with natural visual and manufacturing variation.
Depending on the product and manufacturing method, minor differences may occur in:
- Weave positioning
- Weave direction
- Pattern alignment
- Fiber appearance
- Finish
- Gloss level
- Surface appearance
- Edges
- Underside appearance
- Internal construction
Minor cosmetic variation that does not materially affect the product’s intended appearance, structural integrity, or function does not by itself constitute a defect.
Build Bargain distinguishes between different carbon-fiber constructions when applicable, including products described as wet carbon fiber, matte carbon fiber, dry/pre-peg carbon fiber, or other constructions.
Customers should review the applicable product description for the construction and material being purchased.
5. Carbon-Fiber Weave and Finish
Carbon-fiber components may not have perfectly identical weave positioning from one individual product to another. This will also depend on whether the product is described as carbon fiber (wet carbon fiber construction) or dry carbon fiber (pre-peg carbon fiber construction). Customers can visit our About page to distinguish between the two and decide which construction method best fits their needs.
Complex curves, corners, openings, transitions, and three-dimensional shapes may naturally cause changes in weave direction or appearance.
Minor variations in weave alignment that are inherent to the shape or manufacturing process are not considered defects when the product otherwise meets reasonable quality standards.
Actual defects such as significant structural damage, major finish problems, or other verified manufacturing issues will be reviewed under the applicable Build Bargain warranty or claims policy.
6. Painted, Gloss, Matte and Other Finishes
Products with painted, gloss, matte, clear-coated, polished, brushed, ceramic-coated, or other finishes may appear somewhat different depending on lighting and surrounding conditions.
Customers should inspect the product before installation.
Any visible finish concern should be reported before the product is:
- Installed
- Mounted
- Painted
- Refinished
- Wrapped
- Polished
- Ceramic coated
- Covered with paint protection film
- Otherwise modified
Once a product has been permanently modified or refinished, Build Bargain may be unable to determine its original condition.
7. Product Design and Manufacturing Updates
Build Bargain and its manufacturing partners may occasionally make reasonable improvements, revisions, or production updates to products.
These may include changes to:
- Hardware
- Brackets
- Mounting design
- Internal construction
- Materials
- Packaging
- Wiring
- Connectors
- Modules
- Surface finishing
- Manufacturing process
- Other minor product details
A product may therefore contain a minor revision that is not immediately visible in older product photography.
Reasonable production updates that do not materially change the product purchased, advertised function, intended fitment, or overall design are not considered incorrect products.
If a revision materially changes an advertised feature, Build Bargain will address the issue as appropriate.
8. Product Specifications and Measurements
Product measurements, weights, dimensions, power figures, sound levels, and other specifications may be approximate unless expressly identified as exact.
Manufacturing tolerances and measurement methods may result in minor differences.
Customers who require an exact measurement for a particular application should contact Build Bargain before ordering or modifying the vehicle.
Build Bargain is not responsible for a customer making irreversible vehicle modifications based solely on an approximate measurement without first confirming compatibility.
9. Performance Claims
Performance-related information may include estimates, testing results, manufacturer information, observations, or results obtained under particular vehicle conditions.
Actual results may vary.
Factors affecting performance may include:
- Vehicle model
- Engine
- Factory software
- Tune
- Fuel
- Supporting modifications
- Exhaust configuration
- Intake configuration
- Environmental conditions
- Elevation
- Temperature
- Dyno type
- Testing method
- Vehicle condition
- Installation
Unless expressly guaranteed in writing, an advertised or discussed performance figure should not be interpreted as a guarantee that every vehicle will achieve exactly the same result.
10. Exhaust Sound and Volume
Exhaust sound is subjective and can vary significantly between vehicles.
Factors affecting exhaust sound may include:
- Downpipes
- Midpipe configuration
- Catalytic converters
- Resonators
- Mufflers
- Exhaust valves
- OPF or GPF equipment
- Tune
- Engine configuration
- Vehicle model
- Regional vehicle specification
- Other exhaust modifications
Audio recorded through a phone, camera, microphone, social media platform, or other recording device may sound different from the exhaust in person.
An exhaust sounding different from a customer’s personal expectation does not by itself establish that the product is defective.
11. Lighting Appearance
Lighting products may appear different in photographs and videos than they do in person.
Perceived brightness, color, hue, and intensity can be affected by:
- Camera exposure
- Camera white balance
- Screen settings
- Ambient lighting
- Viewing angle
- Vehicle voltage
- Coding
- Product settings
- Lens design
- Other vehicle conditions
RGB and color-adjustable lighting products may also display colors differently from how those colors appear on a phone or computer screen.
Minor differences in perceived color or brightness do not automatically establish a manufacturing defect.
12. Vehicle-Specific Results
Aftermarket products may behave or appear differently depending on the vehicle on which they are installed.
Two vehicles of the same model may have differences caused by:
- Production date
- Factory options
- Regional configuration
- Software
- Previous repairs
- Vehicle modifications
- Factory tolerances
- Existing aftermarket parts
- Vehicle condition
Fitment and compatibility remain subject to the Limited Warranty, Fitment & Installation Policy.
13. Street Legality and Local Regulations
Customers are responsible for understanding the laws and regulations that apply to the operation and modification of their vehicle.
Vehicle modification requirements may vary by jurisdiction and may include rules relating to:
- Exhaust noise
- Vehicle lighting
- Window or lighting color
- Ride height
- Exterior modifications
- Vehicle inspections
- Safety equipment
- Emissions equipment
- Registration
- Road use
- Motorsport or competition use
The availability of a product for purchase does not automatically mean that the product is legal for every vehicle, every use, or every jurisdiction.
Where a product has a specific legal-use restriction, certification, exemption, or intended-use designation, customers must comply with those requirements.
14. Performance, Off-Road and Track-Use Products
Unless a specific product listing expressly states otherwise, Build Bargain performance products including, but not limited to:
- Downpipes
- Chargepipes
- Intakes
- Midpipes
- Cat-back exhaust systems
- Exhaust components
- Performance piping
- Other performance or emissions-related modifications
are sold and intended for off-road, closed-course, competition, or track use only.
These products are not represented or guaranteed by Build Bargain as street legal unless the applicable product listing specifically and expressly states that the product is street legal for the applicable use.
Automotive modification laws and regulations vary by state, country, city, jurisdiction, vehicle, and application. Customers are responsible for understanding and complying with the laws and regulations that apply where their vehicle is registered, operated, inspected, or used.
Before purchasing, installing, or using a performance product, the customer is responsible for determining whether that product may legally be installed or used on their particular vehicle and in their jurisdiction.
This may include laws or regulations relating to:
- Emissions equipment
- Catalytic converters
- Exhaust systems
- Exhaust noise
- Vehicle inspections
- Smog requirements
- Registration requirements
- Intake systems
- Engine modifications
- Road use
- Competition or track use
- Other vehicle modifications
Build Bargain does not guarantee that a product will pass emissions testing, smog testing, vehicle inspection, or other regulatory requirements unless the applicable product listing expressly provides that guarantee.
If a product is specifically identified by Build Bargain as street legal, CARB compliant, CARB exempt, emissions compliant, or otherwise approved for a particular application, that representation applies only to the specific vehicles, model years, configurations, jurisdictions, and uses stated for that product.
Customers should not assume that a certification, exemption, or street-legal designation for one vehicle or application applies to another.
The customer is responsible for using products only in a manner permitted by applicable law and any restrictions stated on the applicable product listing.
15. California Emissions Requirements
Certain aftermarket performance parts that affect emissions-controlled vehicles may require a California Air Resources Board (CARB) exemption or other applicable authorization before they may legally be used on public roads or for other street use in California.
When a product has a CARB Executive Order or other specific emissions authorization, applicable information may be provided on the product page or accompanying documentation.
A CARB exemption applies only to the vehicles, engines, model years, configurations, and uses covered by that specific authorization.
Customers should not assume that an exemption covering one vehicle or application automatically applies to another.
Unless a product is specifically identified as street legal or CARB compliant for the applicable vehicle and use, customers should not assume that the product is approved for street use in California.
16. Competition and Racing Products
Certain products may be specifically identified for legitimate competition, racing, or other restricted applications.
A competition-use designation does not authorize the customer to use the product unlawfully on a public road or emissions-controlled vehicle.
Customers purchasing a product with a stated use restriction are responsible for complying with the restriction applicable to that product.
17. Emissions and Vehicle Inspection
Modification of an emissions-controlled vehicle may affect:
- Emissions testing
- Smog inspection
- Vehicle inspection
- Registration
- Diagnostic readiness
- Check-engine lights
- Factory emissions monitoring
- Warranty considerations
- Other regulatory requirements
Build Bargain does not guarantee that a modified vehicle will pass a government inspection unless that result is expressly stated for the specific product and application.
Customers should verify applicable requirements before modifying an emissions-controlled vehicle.
18. Proposition 65 and Product Warnings
Certain automotive products, materials, packaging, or components may expose individuals to chemicals subject to California Proposition 65 warning requirements.
When Build Bargain, the manufacturer, supplier, or applicable law requires a Proposition 65 warning, the warning may appear:
- On the applicable product page
- On product packaging
- On a product label
- In accompanying documentation
- At another legally appropriate point before exposure
The presence of a Proposition 65 warning does not by itself mean that a product is defective.
Not every automotive product necessarily requires the same warning.
Customers should review and follow any warnings supplied with the applicable product.
19. Safety Information
Customers are responsible for reviewing and following product-specific safety information, instructions, warning labels, and installation requirements.
Automotive modification may affect vehicle operation, handling, ground clearance, visibility, lighting, sound, emissions, or other vehicle characteristics.
Products should be installed and used only for their intended application.
Do not use a product in a manner known to be unsafe, incompatible with the vehicle, or contrary to applicable instructions.
20. Motorsport and High-Performance Use
Motorsport, competition, track driving, and other high-performance uses place significantly greater stress on vehicles and components than ordinary street driving.
Customers engaging in these activities are responsible for:
- Inspecting the vehicle
- Proper maintenance
- Proper installation
- Confirming component condition
- Following applicable safety requirements
- Understanding the increased risks associated with high-performance driving
Unless expressly stated otherwise for a particular product, Build Bargain does not represent that every product is intended or certified for competitive motorsport use.
21. Third-Party Manufacturer Information
Some product information may originate from a manufacturer or supplier.
Build Bargain makes reasonable efforts to provide accurate product information, but manufacturer specifications, compatibility information, production details, or product designs may occasionally be updated.
If Build Bargain becomes aware of a material error in product information affecting an order, we will contact the customer and address the issue as appropriate.
22. Product Origin and Manufacturing Claims
Build Bargain will not intentionally represent a product as manufactured, assembled, produced, or made in a particular country unless that representation is supported by the information available for the product.
Terms relating to product origin may have different meanings.
A product assembled, inspected, packaged, designed, developed, or shipped from a location is not necessarily manufactured entirely in that location.
Customers with questions regarding a specific product’s manufacturing origin may contact Build Bargain before purchase.
23. Used, Open-Box or Refurbished Products
Unless clearly identified otherwise, products sold as new are represented as new products.
If Build Bargain intentionally sells a product as:
- Used
- Open-box
- Refurbished
- Reconditioned
- Demonstration
- Blemished
- Previously installed
the applicable condition will be disclosed in the product listing or sale terms.
Any condition-specific limitations will be disclosed with that product.
24. Product Misuse
Build Bargain is not responsible for damage caused by use of a product outside its intended application or in a manner inconsistent with applicable instructions or warnings.
This may include:
- Using a vehicle-specific product on an incompatible vehicle
- Exceeding a product’s intended operating conditions
- Improper electrical use
- Unauthorized modification
- Unsafe installation
- Using a component for a purpose it was not designed to perform
Product misuse may also affect applicable warranty coverage.
25. Regulatory Changes
Automotive laws, regulations, inspection requirements, and emissions requirements may change over time.
A product that was lawful for a particular application at one time may become subject to different requirements in the future.
Build Bargain may modify product availability, shipping restrictions, disclosures, or other sales practices when necessary to comply with applicable requirements.
Customers remain responsible for complying with laws applicable to their vehicle and use after purchase.
26. Relationship to Other Build Bargain Policies
Product defects, warranty claims, fitment concerns, and installation matters are governed by the Limited Warranty, Fitment & Installation Policy.
Shipping damage, missing products, incorrect products, and transportation claims are governed by the Shipping, Freight Delivery & Package Claims Policy.
Returns, exchanges, cancellations, custom products, and final-sale terms are governed by the Returns, Exchanges, Cancellations & Custom Orders Policy.
When a product or collection page contains terms specific to a particular product, those product-specific terms also apply.
